Changes to Terms and Conditions
These terms and conditions may be subject to change and alterations periodically. Once any changes to these terms and conditions are posted, these will apply to all orders received. Subsequently these changes will also apply to your use of the Monkey Apple website and constitutes your agreement to and acceptance of such changes.
1. Terms of Sale
1.1. By placing an order through our website you are adhering to the current terms and conditions of Monkey Apple Gallery displayed on our website.
1.2. When placing an order on the website you must represent that all details you provide must be correct and true. These include that you are the owner of the payment card used and have sufficient funds to cover the cost of purchase and delivery charges.
1.3. When you place and order you will receive an email confirmation that your order has been received. The confirmation email that your order has been completed and accepted will be sent to you once your order has been dispatched.
2.1. All product prices are exclusive of delivery charges.
2.2. Prices on this website are subject to change without notice however placed orders will remain unaffected.
3.1. All orders placed on the website must be paid with a debit or credit card that is coherent with our payment options.
3.2. When the order is received, a pre-authorisation check will be carried out on the card to ensure there are sufficient funds to make the purchase.
4. Governing law and Jurisdiction
4.1. Our terms and conditions are in accordance with the laws of England and all disputes will be settled in the English court system.
5. Force Majeure
5.1. Monkey Apple Gallery shall not be liable for any delay of order due to the results of any events/circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, and accidents.
6.1 To be eligible for a refund your item, please email firstname.lastname@example.org and request a refund within 14 days of receiving your order; Don’t forget to give us your order number; Once your request has been accepted, we will liaise with you to arrange collection. In order to qualify for a refund, artworks must be carefully packed and returned in their original packaging;
6.2 Once we receive your item, we will inspect it and notify you that we have received your returned item. If your return is approved we will immediately initiate a refund to you. If the returned item is damaged, we may either: refuse to refund the purchase price and return the damaged item to you; or, where the damage may be repaired, repair the damaged item and issue you a refund of the purchase price less the cost of repairing the damage to the item.
6.3 Monkey Apple will pay for the return of your goods from an address within the UK.
7. Damaged Items
7.1 If you consider a piece of art purchased from us to be damaged, please email us photographs of the damage at email@example.com within 10 days of receiving your art and, after assessing the damage, we may either arrange for the item to be returned to us free of charge and refund the purchase price, or send you replacement item.
